"COMMANDER ANTARCTIC" promotion - Terms and Conditions
- Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian residents who are available to travel on 31 December 2008. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
- To enter, entrants must visit www.commander.com/HowGreenIsMyServer during the promotional period where they will be asked to answer 6 multiple choice questions to receive a rating on "How Green Your ICT System is". To enter for the draw to win the first prize, individuals must follow the prompts to the questions, and input the requested details including their last and first name, company name, telephone number and valid email address. In addition to this, the first 100 entrants to complete the online quiz and leave the requested details, will each receive a heat sensitive coffee mug valued at $9.50 each.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Incomplete, indecipherable, or illegible entries will be deemed invalid.
- Multiple entries permitted, subject to each entry being submitted separately and in accordance with entry requirements.
- Promotion commences on 23 June 2008. Entries close 5:30pm AEST on 18 September 2008. The draw will take place at 120B Underwood Street, Paddington NSW 2021 on 22 September 2008 at 12:30pm AEST. Winners will be notified by mail and First Prize winner will have their name published in The Australian on 1 October 2008. The Promoter's decision is final and no correspondence will be entered into.
- The first valid entry drawn will win a return economy sightseeing flight over Antarctica for 2 people departing from Sydney, valued at $2,798 (including airport departure taxes). Winner and companion must make their own way to departure point. Taxes, insurance, transport to and from departure point, transfers and all other ancillary costs are not included. Prize must be taken on 31 December 2008 and is subject to booking and flight availability. The winner and their companion must travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
- If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
- In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
- If the winner of the major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
- If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Total prize pool value is up to $3,748.
- Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
- A draw for any unclaimed prizes may take place on 22 December 2008 at the same time and place as the original draw, subject to any directions from a regulatory authority. In the event of a winner, they will be contacted immediately by phone and their name will be published in The Australian on 24 December 2008.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Antarctica Sightseeing prize event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) the prize.
- The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
